Terms and Conditions for Fancy Reports

Welcome to Fancy Reports! These Terms and Conditions ("Terms") govern your access to and use of the Fancy Reports SaaS application ("Service"). By using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Service.

1. Definitions

"We," "Us," "Our" refers to Fancy Reports Pty Ltd.
"You," "Your" refers to the individual or entity using the Service.
"Service" refers to the Fancy Reports SaaS application, including all features and functionalities.

2. User Accounts

To access the Service, you must register and create an account.
You must provide accurate, current, and complete information during the registration process and update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your password and for any activities or actions under your account.
You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms.
You must not use the Service:
In any way that violates any applicable local, national, or international law or regulation.
For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter", "spam", or any other similar solicitation.
To impersonate or attempt to impersonate Fancy Reports Pty Ltd, a Fancy Reports Pty Ltd employee, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing).
To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm Fancy Reports Pty Ltd or users of the Service or expose them to liability.
Additionally, you agree not to:
Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party's use of the Service, including their ability to engage in real time activities through the Service.
Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service.
Use any manual process to monitor or copy any of the material on the Service or for any other unauthorized purpose without our prior written consent.
Use any device, software, or routine that interferes with the proper working of the Service.
Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
Attack the Service via a denial-of-service attack or a distributed denial-of-service attack.
Otherwise attempt to interfere with the proper working of the Service.

4. Subscription and Payment

The Service is provided on a subscription basis. You agree to pay all fees specified at the time of your subscription.
Payment is due in advance for the subscription period and is non-refundable.
We reserve the right to change the subscription fees at any time, but any changes will only apply to subsequent billing cycles.
If payment is not received by the due date, we reserve the right to suspend or terminate your access to the Service.

5. Data and Privacy

By using our Service, you agree to the collection, use, and disclosure of your data as described in our Privacy Policy.
We will take reasonable measures to protect your data but cannot guarantee its absolute security.
You are responsible for maintaining and protecting all data that you use in conjunction with the Service.

6. Intellectual Property

All content, features, and functionality on the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of Fancy Reports Pty Ltd and its licensors.
You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms.
You must not use any part of the content on our Service for commercial purposes without obtaining a license to do so from us or our licensors.

7. Prohibited Activities

You agree not to:
Use the Service in any way that breaches any applicable local, national, or international law or regulation.
Transmit any data, send, or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
Attempt to gain unauthorized access to the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party’s use of the Service.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, if you breach these Terms.
Upon termination, your right to use the Service will immediately cease.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, whether express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects in the Service will be corrected.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Fancy Reports Pty Ltd be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Your access to or use of or inability to access or use the Service.
Any conduct or content of any third party on the Service.
Any content obtained from the Service.
Unauthorized access, use, or alteration of your transmissions or content.

11. Indemnification

You agree to defend, indemnify, and hold harmless Fancy Reports Pty Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Queensland, Australia without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
